In the following, the contractual relationship between the customer and participants (hereinafter “participant”) in events such as seminars, workshops, courses and conferences (hereinafter “events”) and the Quantum Business Network UG (haftungsbeschraenkt), hereinafter “QBN”, regulated. Only the general terms and conditions for booking and participation in QBN events apply, hereinafter referred to as “GTC”. Deviating or conflicting conditions of the participant will only be recognized if they have been expressly agreed in writing. Participants within the meaning of these terms and conditions are both consumers and entrepreneurs. Consumers in the sense of these terms and conditions are natural persons with whom business relationships are entered into without them being a commercial or self-employed, professional activity can be attributed. Entrepreneurs in the sense of these terms and conditions are natural or legal persons or legal partnerships with whom a business relationship is entered into and who act in the exercise of a commercial or independent professional activity.
The terms and conditions apply to all current and future business relationships.
Registration can only be made via the QBN website. If a participant books an event, receipt of the order is first confirmed. This confirmation of receipt does not yet constitute a binding acceptance of the booking. The registration becomes legally binding through our written declaration of acceptance. As the number of participants for our events is limited, not all registrations can be accepted.
Payment is made using the payment method selected by the participant in the booking process.
German law applies. If the participant is a businessman, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Munich. The same applies if the participant does not have a general place of jurisdiction in Germany or if their place of residence or habitual abode is not known at the time the action is brought.
The amount of the participation fee can be found in the corresponding event announcement. They relate to a person and an event date. The statutory value added tax is shown separately in the booking process. The participation fee is to be paid accordingly during the booking process. When paying by invoice, this is due within 14 days of receipt of the invoice. Payment by sending cash or checks is not possible; QBN is not liable in the event of loss. If the participant is in default of payment, QBN is entitled to assert the damage caused by default. During the delay, the consumer has to pay interest on the money debt at a rate of 5% above the base rate. QBN reserves the right to prove and assert higher damage caused by default vis-à-vis the entrepreneur. The participant can only offset claims that have been legally established or recognized in writing by QBN. The participant is only authorized to exercise a right of retention if his counterclaim is based on the same contractual relationship.
Cancellation policy
A consumer is any natural person who completes a legal transaction for purposes that are for the most part not attributable to any professional activity of either a commercial or self-employed nature they engage in.
Right of cancellation
If the event cannot be held due to force majeure or an important reason (e.g. due to illness of the speaker or insufficient number of participants), the participants will be informed as soon as possible and the event fee will be reimbursed. Any further claims, in particular the reimbursement of travel and accommodation costs as well as loss of work, are excluded, unless such costs arise due to grossly negligent behavior on the part of QBN.
You have the right to cancel this contract without giving reasons within a fourteen-day cancellation period that begins on the day on which the contract is concluded but no later than 21 days before the start of the event. After that or if the participant does not show up, we will charge the entire participation fee. The cancellation must be in writing.
QBN accepts a substitute participant at no additional cost.

You can – but are not required to – use the cancellation form template appended to this cancellation policy. You will be deemed to have complied with the aforementioned cancellation period if your letter or email notifying us of the use of your right of cancellation was sent prior to the expiry of the cancellation period.
Consequences of cancellation
If you cancel this contract we are required to pay back all payments we have received from you (including delivery costs but excluding additional costs incurred as a result of you selecting a different delivery type to the standard, lowest cost delivery type we offer) without delay and within a maximum period of fourteen days from the date on which we receive your correspondence notifying us of your cancellation of this contract. Repayment occurs using the same payment type you used for the original transaction unless otherwise agreed with you; you will not be charged any fees in connection with repayment.

Exclusion and premature expiry of the right of cancellation
The right of cancellation does not apply to contracts for the supply of digital content that is not prefabricated and whose fabrication is either defined by the options selected and purposes intended by the consumer or clearly tailored to the consumer’s personal requirements. The right of cancellation expires prematurely if we only commence the performance of the contract after you grant your express consent and thus confirm your awareness of the fact that you lose your right of cancellation upon such time as we commence the performance of the contract. We point out that we are entitled to make the aforementioned consent and confirmation a prerequisite for the conclusion of the contract.
The participation fee includes participation in the event. If conference documents are provided, these are also included in the price. QBN reserves the right to replace announced speakers with others and to make necessary changes to the event program while maintaining the overall character of the event.
The conference documents are protected by copyright. The reproduction, distribution or other use of the conference documents is only permitted with the express consent of QBN. The list of participants as well as documents and information about the event are available to all QBN members. Non-members are not entitled to access to lists of participants and information and documents on the event, with the exception of the event documents, provided that these have been announced for all participants.
In the case of slightly negligent breaches of duty, our liability is limited to the foreseeable, contract-typical, direct average damage based on the type of event. This also applies to slightly negligent breaches of duty by our legal representatives or vicarious agents. We are not liable to entrepreneurs for slightly negligent breaches of insignificant contractual obligations. This applies in particular to the topicality, correctness and completeness of conference documents and to the implementation of events. Liability for culpable injury to life, limb or health remains unaffected. Unless otherwise regulated above, liability is excluded.
The terms and conditions remain binding in their remaining parts even if individual provisions are legally ineffective. Ineffective conditions are replaced by those that come closest to the economic purpose of the ineffective ones. Agreements that differ from this contract are only effective if they are agreed in writing.
Im Folgenden wird das Vertragsverhältnis zwischen dem Besteller und Teilnehmer (im Folgenden „Teilnehmer“) an Veranstaltungen wie Seminaren, Workshops, Kursen und Konferenzen (im Folgenden „Veranstaltungen“) und der Quantum Business Network UG (haftungsbeschränkt), im Folgenden „QBN“, geregelt. Es gelten ausschließlich die Allgemeinen Geschäftsbedingungen für die Buchung und die Teilnahme an Veranstaltungen von QBN, im Folgenden „AGB“. Abweichende oder entgegenstehende Bedingungen des Teilnehmers werden nur anerkannt, wenn sie ausdrücklich schriftlich vereinbart wurden. Teilnehmer im Sinne dieser Geschäftsbedingungen sind sowohl Verbraucher als auch Unternehmer. Verbraucher im Sinne dieser Geschäftsbedingungen sind natürliche Personen, mit denen in Geschäftsbeziehungen getreten wird, ohne dass diesen eine gewerbliche oder selbstständige, berufliche Tätigkeit zugerechnet werden kann. Unternehmer im Sinne dieser Geschäftsbedingungen sind natürliche oder juristische Personen oder rechtsfähige Personengesellschaften mit denen in Geschäftsbeziehung getreten wird und die in Ausübung einer gewerblichen oder einer selbstständigen beruflichen Tätigkeit handeln.
Die AGB gelten für alle gegenwärtigen sowie für alle zukünftigen Geschäftsbeziehungen.
Die Anmeldung kann ausschließlich über die QBN Webseite vorgenommen werden. Bucht ein Teilnehmer eine Veranstaltung, wird zunächst der Zugang der Bestellung bestätigt. Diese Zugangsbestätigung stellt noch keine verbindliche Annahme der Buchung dar. Die Anmeldung wird durch unsere schriftliche Annahmeerklärung rechtsverbindlich. Da die Teilnehmerzahl für unsere Veranstaltungen begrenzt ist, können nicht alle Anmeldungen angenommen werden.
Die Zahlung erfolgt über die vom Teilnehmer ausgewählte Zahlungsart im Buchungsprozess.
Es gilt deutsches Recht. Ist der Teilnehmer Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag München. Dasselbe gilt, wenn der Teilnehmer keinen allgemeinen Gerichtsstand in Deutschland hat oder Wohnsitz oder gewöhnlicher Aufenthalt zum Zeitpunkt der Klageerhebung nicht bekannt sind.
Die Höhe der Teilnahmegebühren ist der entsprechenden Veranstaltungsankündigung zu entnehmen. Sie beziehen sich auf eine Person und einen Veranstaltungstermin. Die gesetzliche Mehrwertsteuer wird im Buchungsprozess gesondert ausgewiesen. Die Teilnahmegebühr ist entsprechend während des Buchungsprozesses zu begleichen. Bei Zahlung per Rechnung ist diese innerhalb von 14 Tagen nach Erhalt der Rechnung fällig. Bezahlung durch Übersendung von Bargeld oder Schecks ist nicht möglich, bei Verlust haftet QBN nicht. Kommt der Teilnehmer in Zahlungsverzug, ist QBN berechtigt, den Verzugsschaden geltend zu machen. Der Verbraucher hat während des Verzugs die Geldschuld in Höhe von 5% über dem Basiszinssatz zu verzinsen. Gegenüber dem Unternehmer behält sich QBN vor, einen höheren Verzugsschaden nachzuweisen und geltend zu machen. Der Teilnehmer kann nur mit rechtskräftig festgestellten oder von QBN schriftlich anerkannten Ansprüchen aufrechnen. Zur Ausübung eines Zurückbehaltungsrechts ist der Teilnehmer nur befugt, wenn sein Gegenanspruch auf demselben Vertragsverhältnis beruht.

Die Teilnahmegebühr beinhaltet die Teilnahme an der Veranstaltung. Sofern Tagungsunterlagen vorgesehen sind, so sind diese auch im Preis inbegriffen. QBN behält sich vor, angekündigte Referenten durch andere zu ersetzen und notwendige Änderungen des Veranstaltungsprogramms unter Wahrung des Gesamtcharakters der Veranstaltung vorzunehmen.
Die Tagungsunterlagen sind urheberrechtlich geschützt. Die Vervielfältigung, Weitergabe oder anderweitige Nutzung der Tagungsunterlagen ist nur mit ausdrücklicher Zustimmung von QBN gestattet. Die Teilnehmerliste sowie Dokumente und Informationen zur Veranstaltung sind für alle QBN Mitgliedern zugänglich. Nicht-Mitglieder haben keinen Anspruch auf Zugang zu Teilnehmerlisten sowie Informationen und Dokumenten zur Veranstaltung, mit Ausnahme der Veranstaltungsunterlagen, sofern diese für alle Teilnehmer angekündigt wurden.
Bei leicht fahrlässigen Pflichtverletzungen beschränkt sich unsere Haftung auf den nach Art der Veranstaltung vorhersehbaren, vertragstypischen, unmittelbaren Durchschnittsschaden. Dies gilt auch bei leichtfahrlässigen Pflichtverletzungen unserer gesetzlichen Vertreter oder Erfüllungsgehilfen. Gegenüber Unternehmern haften wir bei leicht fahrlässiger Verletzung unwesentlicher Vertragspflichten nicht. Dies gilt insbesondere auch für die Aktualität, Richtigkeit und Vollständigkeit von Tagungsunterlagen und für die Durchführung von Veranstaltungen. Die Haftung wegen schuldhafter Verletzung des Lebens, des Körpers oder der Gesundheit bleibt unberührt. Soweit nicht vorstehend etwas Abweichendes geregelt ist, ist die Haftung ausgeschlossen.
Die AGB bleiben auch bei rechtlicher Unwirksamkeit einzelner Bestimmungen in ihren übrigen Teilen verbindlich. Unwirksame Bedingungen werden durch solche ersetzt, die dem wirtschaftlichen Zweck der unwirksamen am nächsten kommen. Von diesem Vertrag abweichende Vereinbarungen sind nur wirksam, wenn sie schriftlich vereinbart werden.
